The
stern decision suggested the case was “one in a million”
The Supreme Court ruled against the Nobuhiras in a lawsuit they filed
that was based on fabricated allegations. The suit was dismissed as
an “abuse of the right of action.”
A decision of an “abuse of the right of action” is extremely
rare. What was the reason behind such a severe finding? The ruling,
in summary, concluded as follows:
From the outset, this case was based on fictitious stories with the
sole purpose of harassment. This lawsuit was concluded because if
it continued, the court would be assisting in the Nobuhiras’
unlawful plot.
